GENERAL CONDITIONS OF CONTRACTING:
1.- IDENTIFICATION OF THE PARTIES.
On one hand PENTA CENTRO DE ANÁLISIS CLÍNICOS, S.L., hereinafter PENTA, whose other identification data appear in the Legal Notice and holder of the domain WWW.PENTALABORATORIO.COM, hereinafter Website, and on the other hand; the User who contracts the products offered through the Website.
2.- ACCEPTANCE AND MODIFICATION.
The User declares that they have legal capacity* to contract and accepts full and unconditional adherence to the General Conditions of Contracting, hereinafter CGC, in the version published at the time of contracting.
*LEGAL LIMITATIONS: Sale to minors under 18 years of age is prohibited. Minors have technically restricted registration on this Website and therefore will not be able to make purchases, in compliance with legal regulations. Data sent by minors will not be processed, as legislation prevents it.
3.- OBLIGATIONS OF THE PARTIES.
3.1.- Obligations of PENTA:
- Provide services in accordance with the CGC and without breaching contractual good faith.
- Make the CGC and particular conditions available to the User, where applicable.
- Send the User proof of receipt or invoice for the contracted products.
3.2.- Obligations of the User:
- Fully comply with what is established in the CGC.
- Complete registration forms with truthful and current information. The User shall be solely responsible for the truthfulness and updating of the information.
- Maintain the confidentiality of the information provided and immediately notify the loss, misplacement, theft, robbery, unauthorized access, as well as its knowledge by third parties.
4.- PRODUCT AVAILABILITY.
In case of temporary unavailability of a product, the User will be informed by email of this fact and the new estimated delivery period. In case the product is finally not available, once informed of this through email, they may receive a product with similar characteristics or cancel the order.
5.- PRICES.
Published prices include the corresponding VAT. If there are shipping costs, they will appear at the moment of purchase. The User will be able to know the amount of such costs at the time of contracting the product.
6.- PAYMENT METHODS.
- Payment by credit card (VISA or Mastercard).
7.- TRANSMISSION OF RISK AND OWNERSHIP.
The User acquires ownership of the products at the moment of full payment of all amounts, including shipping costs.
The risk of loss or deterioration shall be transferred to the User when they or a third party indicated by them, other than the carrier, has acquired its material possession. In case the User arranges the transport or the carrier chosen is not among those proposed by PENTA, the risk shall be transferred to the User upon delivery of the goods to the carrier.
8.- SHIPPING AND RETURNS POLICY.
SHIPPING
Shipping periods are set at 1-3 business days in mainland Spain and 3-5 business days for the rest of territories. PENTA reserves the right to reject returns due to a delay by the logistics company.
Collection will be made within 1-2 days following notice by the customer. Collection will be made at the address specified by the customer.
In any case PENTA shall deliver the products to the User within a maximum of 30 business days from the conclusion of the contract.
Once the contract is concluded, the User will receive a purchase confirmation email plus another delivery email once the order has been handed over to the carrier.
RETURNS
Due to the nature of our tests and for hygienic reasons, returns are not accepted.
If you receive a defective product (it must be reported within 24 hours following receipt of the order), send us images clearly showing the defect, as well as images of the box so we can verify it and provide you with a solution.
9.- PROCEDURE, CANCELLATION AND WITHDRAWAL RIGHTS, AND LEGAL WARRANTY.
9.1.- Procedure.
To exercise the rights of cancellation, withdrawal and use of the warranty, the User must contact PENTA through 965 270 536, info@pentalaboratorio.com, via WhatsApp or through our online store.
9.2.- Right of Cancellation.
The User may cancel their order at no cost as long as this is communicated before the order has been made available to the carrier.
9.3.- Right of Withdrawal.
The User shall have a period of 14 business days from when they acquire possession of the item to withdraw from the contract without need for justification and without any penalty.
The right of withdrawal shall be applicable as long as the contracted products are returned in the same condition (together with their complete original packaging, labels and together with any accessories related to them), and the purchase invoice is enclosed. In any case, PENTA shall determine whether these requirements are met.
If this right is granted, the User shall assume the cost of returning the products; if not granted, the products will be sent with postage due.
The right of withdrawal shall not be applicable to contracts referring to the supply of goods made according to the specifications of the User or clearly personalized.
9.4.- Legal Warranty.
The User has a period of two years warranty from product delivery. This warranty does not include deficiencies caused by negligence, bumps, misuse or improper handling by the User. Absent proof to the contrary, it shall be presumed that the lack of conformity that becomes apparent in the six months following product delivery already existed when the item was delivered.
The legal warranty comprises the following rights for the User:
- If the product does not conform to the contract, the User may choose to demand the repair or replacement of the product, unless one of these two options is objectively impossible or disproportionate to the detriment of PENTA. All costs for exercising this right shall be free for the User.
- The price reduction and the contract termination shall proceed, at the User's choice, when they could not demand repair or replacement and in cases where these have not been carried out within a reasonable period or without greater inconvenience to the User. Termination shall not proceed when the lack of conformity is of minor importance.
10.- NOTIFICATIONS.
PENTA designates as address for notification purposes the one stipulated in the Legal Notice. The email address provided by the User during the registration process will be used by PENTA for the purpose of making notifications. All notifications made in accordance with the indicated procedure shall be considered validly served.
11.- COMPETENT JURISDICTION.
In case of dispute between the parties, territorial jurisdiction shall correspond, at the User's choice, to their domicile or that of the defendant.
