GENERAL CONDITIONS OF USE OF PENTALABORATORIO.COM

 

1.- OBJECT.

These general conditions of use (hereinafter CGU), regulate access to and use of the Website under the domain PENTALABORATORIO.COM(hereinafter Website), owned by "PENTA CENTRO DE ANÁLISIS CLÍNICOS, S.L." (hereinafter PENTA), made available to users (hereinafter User/s).

2.- CONFORMITY WITH THESE GENERAL CONDITIONS.

The use of the Website implies the full acceptance by the User of the CGU in force at each moment when the User accesses it. Therefore, if the User does not agree with any of the conditions established here, the User should refrain from using this Website.

Consequently, the User must carefully read the CGU each time they intend to use the Website.

In any case, PENTA reserves the right to modify, without prior notice and at any time, the CGU. Likewise, PENTA reserves the right to suspend, interrupt or cease operating the Website at any time.

By "use of the Website", any User is understood to access and browse the Website regardless of whether they complete registration forms.

 

3.- CONDITIONS OF ACCESS AND USE OF THE WEBSITE AND ITS CONTENTS.

The User is obliged to comply with the CGU, as well as to comply with special warnings or instructions contained in the Website and to always act in accordance with the law, good customs and the requirements of good faith, employing maximum care taking into account the nature and compensation of the service they enjoy. To this end, they shall refrain from using the Website in any way that could prevent, damage or deteriorate its normal functioning, the property or rights of PENTA, its suppliers, its distributors, other Users or in general any third party.

  2. b) Not to introduce, store or disseminate through the Websiteany computer program, data, virus, code, or any other electronic or physical instrument or device that is capable of causing damage to the Website, any of the services, or any of the equipment, systems or networks of PENTA, any User, the Suppliers or Distributors of PENTAor in general any third party, capable of causing any type of alteration or preventing normal functioning of the same.
  3. c) Not to introduce, store or disseminate through the Websiteany content that infringes intellectual property, industrial property or third party rights, nor in general any content of which the User did not hold, in accordance with the law, the right to make it available to third parties.

 

3.2- Access and Use of Contents.

The Contents of the Website are made available to the User with information from both own and third-party sources.

PENTA seeks to ensure that the Contents are of the highest possible quality and are reasonably updated, but does not guarantee the usefulness, accuracy, completeness, relevance and/or currency of the Contents.

 

4.- INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

PENTA does not guarantee the availability and continuity of the operation of the Website and the services or Contents offered in it, nor that the content existing in its Website is updated, being exempted from all responsibility for any damages that may arise from such circumstances.

PENTA will carry out, provided that circumstances do not make it impossible or difficult to execute and as soon as it becomes aware of errors, disconnections and/or lack of updating of the contents, all those tasks aimed at correcting the errors, restoring communications and/or updating the aforementioned contents.

Likewise, PENTA does not guarantee either the technical reliability of its Website, nor access to its different pages, being similarly exempted from all responsibility for any damages that may arise from this cause.

7.- ACTIONS IN CASE OF NON-COMPLIANCE.

PENTA reserves the right to exercise all actions available in law to enforce the responsibilities arising from the breach of any provision of these General Conditions of the Website by a user.

 

8.- PARTIAL NULLITY.

The declaration of any of the clauses contained in these General Conditions as null, invalid or ineffective shall not affect the validity or effectiveness of the remaining ones, which shall continue to be binding between the parties.

 

9.- APPLICABLE LAW AND JURISDICTION.

These CGU shall be governed by the provisions of Spanish legislation.

Any controversy relating to the conditions of use and access to this Website contained in this CGU document of the Website, the parties submit themselves, expressly waiving any other jurisdiction that could correspond to them, unless it is determined otherwise by legal imperative, to the Courts of Benidorm.
